The Town of Yarmouth is participating in a one-year Pilot Project with the Cape Cod Commission for a web-based zoning tool developed by OpenCounter. The OpenCounter Zoning Portal provides basic information on types of uses or businesses that may be allowed by-right, allowed with the issuance of a Special Permit(conditional), and those uses that are prohibited. The Portal allows you to search by address, or if you don't have a specific site in mind, the map will depict where in the Town the use would be allowed, conditional or prohibited.
The Zoning Portal only addresses uses and does not include requirements related to dimensional standards such as setbacks, building heights, site layout criteria, or architectural and site design standards that may be required by Zoning. The Portal also does not include information on prior relief given for a property or lawfully pre-existing grandfathered uses. Information on prior relief granted by the Zoning Board of Appeals can be found on the town website at Town Record Search.
Although every effort has been made to provide accurate information on this site for our underlying zoning and incentive based optional overlay districts, zoning can be complex. Town Staff are available to assist the publicand developers in navigating the Zoning Bylaw and other Town permits which maybe required for a specific development. Prior to moving forward with a project, uses should be verified by the Building Commissioner, who serves as the Zoning Enforcement Officer.
