Board of Appeals

1. Why do I need a Special Permit or Variance?

The most common reason why a Special Permit is necessary is that the proposed dwelling or altered dwelling does not meet setback requirements set forth in the bylaw. Therefore, in order to "alter, change or extend a pre-existing non-conforming structure", you may need relief from the bylaw in the form of a Special Permit or Variance. Usually you will be referred to the Board of Appeals by the Building Commissioner upon application for a building permit. Requirements for a Special Permit or Variance are set forth in the Zoning bylaw.

2. How long does it take to get a Special Permit or Variance?

The appeal process generally takes four to five weeks, depending on the project. You can help move the process along by providing the Board with up-to-date information (and by providing the Board with all the necessary information and plans, including Certified Plot Plans). Please refer to the Application packet for more information on what must be submitted, or check with the Board Secretary.

3. What's the difference between a Special Permit and a Variance?

A Special Permit is required generally if your structure is non-conforming and you wish to make an alteration or extension to it. The Board of Appeals approval or special exceptions shall not be granted unless the applicant demonstrates that "no undue nuisance, hazard, or congestion will be created and that there will be no substantial harm to the established or future character of the neighborhood nor of the town".

A variance is required if you want to do something with your property which is generally prohibited by the Zoning Bylaw. The applicant must show a hardship imposed by the Bylaw which is caused by a unique condition of the lot, or structure, and the hardship is owing to circumstances relating to the soil conditions, shape or topography of the land or structure and especially affecting the land or structures, but not affecting generally the zoning district in which it is located. Relief may be granted without substantial detriment to the public good, and without nullifying or substantially derogating from the intent or purpose of such ordinance or bylaw. The criteria for a Variance is very strict, you might want to look at all of your options before applying.

4. I just received a notice that my neighbor is applying for a Special Permit or Variance for his property. What should I do?

You should call or visit the Board of Appeals office to review the plans, prior to the hearing. The Board receives correspondence and or commentary from the public during the hearing process and considers these comments in rendering their decision. Letters received prior to the hearing will be read into the record.

5. What happens at the public hearing?

The Board Chairman will open the hearing by reading the application or legal ad into the record. The applicant (or their representative) is then called to make their presentation to the Board. Correspondence received from other town boards and or committees is read into the record as well as any correspondence from abutters. The Board members may ask questions of the applicant, and then the Chairman will ask if any audience members wish to speak. After all of the input the Board may close the public portion and discuss the request among themselves. A decision is usually made the night of the hearing and the Special Permit and or Variance is granted or denied at that time.

6. What happens after the Board reaches a decision?

Once the matter has been decided, a decision is written and recorded with the Town Clerk. After a 20 day appeal period, the permit is mailed to the applicant, who then files the permit with the Barnstable County Registry of Deeds. A copy is forwarded to the Board of Appeals Office and the Building Department. The Building Department may not issue a building permit or occupancy permit without receiving a copy of that recorded decision.

7. What if I 'm not happy with the Board's decision?

You may appeal the decision at Barnstable County Superior Court. Appeals procedures are outlined in M.G.L. Ch. 40A §17 and must be filed within 20 days of the filing of the decision with the Town Clerk.

3. I want to add a bedroom/addition to my house. What is required?

The Health Department, through our office records, will help you determine if your existing septic system is large enough to accommodate your proposed renovations, in addition to meeting the required setbacks. Our office will also determine if your house lot is located within the Town of Yarmouth Zone II Areas of Wellhead Contribution. In general, properties located within this Zone II are limited to 1 bedroom per 10,000 square feet of land area. For example, a vacant lot of 20,000 square feet that is located within the Zone II is limited to 2 bedrooms with the installation of a standard Title V septic system. If your existing house and lot do not meet the minimum standard, you may be required to record a Deed Restriction on your property deed, which limits the total number of bedrooms, at the Barnstable County Registry of Deeds. Don’t forget to check with the Building Department at (508) 398-2231 ext. 261 to address any zoning issues.

4. My septic has failed; what do I do?

Contact a design engineer who will design a new septic system based on the total number of bedrooms for residential properties. The design of the septic system is a multi-step process that usually involves a survey of your property, a soil and percolation test, and a sketch of your house floor plan all of which can take up to 2- 3 months depending on your engineer’s schedule, the backlog of scheduled soil tests, and the review of the final septic plan by the Health Department. 6. When is a Building Permit required?

A Building Permit is required whenever a project includes construction,reconstruction, alterations, repair, removal or demolation of a structure. Also a permit is required for any change of use of a building or structure and /or the installation or alteration of any equipment that is regulated by the State Building Code.

7. Do I need a Plot Plan as part of my building application?

Yes, A Plot Plan is required if the proposed construction involves a new structure, an addition to an existing structure, reconstruction, or if the department has no record of a Plot Plan for the property and the proposed work is structural and not an ordinary repair.

8. How long are permits good for?

Any building permit issued shall be deemed abandoned and invalid unless the work authorized by it shall have commenced within six months after issuance.

9. What about the issuance of plumbing, gas or wiring permits?

These permits are only issued to Massachusetts licensed plumbing, gas fitters and electrical.

1. Where can I purchase a beach sticker?

Residents can purchase them at Town Hall at the Clerks Office. Daily, Weekly and Weekend Parking Stickers can be purchased right at the beaches after the second weekend in June. Resident stickers may also be available at the Yarmouth Chamber of Commerce.

2. Where can I purchase a daily boat trailer sticker at Bass River Beach?

Boat trailers passes and stickers are available at Bass River Beach either at the gate from the booth attendant or at the box located near the boat ramp.

3. How do I go about getting a Memorial Bench at the beach?

You can call the Building and Grounds Division at (508) 775-2516 and ask for Roby Whitehouse. There is currently space for new Memorial Benches at Seaview Beach, Thacher Park and Grey's Beach.

4. Why is there so much seaweed on the beaches?

Seaweed washes in due to inclimate weather.

5. How can my business or organization Adopt an Island (landscape in the Town of Yarmouth)?

1. When are Real Estate tax bills due?

The Town of Yarmouth isues Real Estate and Personal Property bills annually. The first half is due approximately on November 1st and the 2nd half is due May 1st.

2. Can I pay less than the real estate tax due?

Yes, partial payments are accepted but each payment must be at least 10% of the original tax and interest will accrue @14% per annum on the balance. Partial payments are only accepted until the time of Tax Title Process begins.

3. Can I pay my tax bill by credit card?

On line EBILL (www.MCC.net) is available with MC, Visa and Debit cards for Real Estate, Personal Property and Excise taxes 30 days prior to due date and for full payments only. The only credit card accepted by the Collector's office in the Town Hall is Discover Card.

4. Why is the former owner's name on my real estate tax bill?

The State mandates tax bills to be assessed to the owner of record as of January 1st prior to the new fiscal year of July 1st. It is very important to sumit any ownership changes and mail address updates to the Assessor's Office in writing at the time of closing. It may take many months before the Town is notified from the Registry of Deeds of transfers. Taxes are adjusted at the closing between the buyer and seller.

5. How much are Municipal Lien Certificates?

6. Why doesn't my exemption show on my real estate bill?

Exemptions are granted by the Board of Assessor's based on State guidelines for qualified elderly, veterans and blind, therefore, applications must be filed each tax year. Please check with the Assessor's Office for more information.

7. Can you correct my mailing address on my car excise bill?

The Town of Yarmouth cannot change these addresses. You need to notify the Registry of Motor Vehicles and your insurance company of any address change immediately. If you do not receive an excise bill, please contact this office @508-398-2231 Ext. 233.

8. Why is my tax payment sent to a Worcester P.O. Box?

We now have a Bank Lock Box Center in Worcester, therefore, tax bill payments will be sent to the Reading Post Office Box.

1. What is the Community Preservation Act (CPA)?

Community Preservation Act (CPA) legislation was designed to help Massachusetts towns and cities plan ahead for sustainable growth and provide funds to achieve their community preservation goals. The CPA (MGL. c. 44B) was enacted by state legislators in 2000 allowing any Town in the Commonwealth to adopt a property tax surcharge of up to 3%, the revenues from which and any matching state funds (currently 100%) could be directed to community housing, historic resources, open space, and recreational projects.

2. When did Yarmouth adopt the CPA?

In January 2005, the Town of Yarmouth voters adopted the CPA with a 3% surcharge, and simultaneously withdrew from the Cape Cod Land Bank (CCLB).

3. What is the Community Preservation Committee?

The Yarmouth Community Preservation Committee (CPC) was created in April 2005.

The CPC consists of nine voting members. Seven members represent existing committees from the Affordable Housing Committee, Conservation Commission, Historical Commission, Open Space Committee, Planning Board, Recreation Commission, and the Yarmouth Housing Authority. The two remaining seats are citizen-at-large positions appointed by the Board of Selectmen.

The Committee reviews applications and makes recommendations to Town Meeting for community housing, historic, open space, and recreation projects.

4. How may I obtain a CPA application?

The Community Preservation Act application is available online or at Town Hall in the Department of Community Development. Click here to view the CPA application.

5. Who decides how to spend the revenue?

You decide! The legislative body of Yarmouth (Town Meeting) ultimately approves any CPA expenditures, based on the recommendations of the Community Preservation Committee.

The Committee is required to study the community preservation needs of the city or town, hold a public hearing, consult with relevant boards and committees and make recommendations to the legislative body for the expenditure of CPA funds. The legislative body may approve, reduce or reject the recommended appropriations, or it may reserve CPA funds for future projects.

6. When are applications due for the FY09 grant round?

Complete applications must be submitted by November 3, 2008 at 4:30 p.m. to be eligible for consideration at Annual Town Meeting 2009.

Twelve (12) copies and all accompanying documents must be hand-delivered or mailed to the Town Hall at the address below.

7. Are restrictions placed on properties which receive Community Preservation funds?

Most projects are subject to permanent deed restrictions that meets the requirements of M.G.L c. 44B §12 and M.G.L. c. 184 §23 to 31.

Types of restrictions may include affordable housing deed riders, historic preservation restrictions, and conservation restrictions. Restrictions run with the land in perpetuity and are enforced by a governing agency.

8. What constitutes "community housing"?

Housing for low to moderate income individuals and families, including low or moderate income seniors.

Moderate income is less than 100%, and low income is less than 80%, of U.S. HUD Area Wide Median Income.

9. What constitutes "historic resources"?

A building, structure, vessel, real property, document or artifact listed or eligible for listing on the State register of historic places or determined by the Yarmouth Historical Commission to be significant in the history, archeology, architecture or culture of Yarmouth.

10. What constitutes "open space"?

Land to protect existing and future wellfields, aquifers and recharge areas, watershed land, agricultural land, grassland, fields, forest land, fresh and salt water marshes, and other wetlands, ocean, river, stream, lake and pond frontage, beaches, dunes and other coastal lands, lands to protect scenic vistas, land for wildlife or nature preserve and land for recreational use.

11. What constitutes "recreational land"?

Land for active or passive recreational use including, but not limited to, the use of land for community gardens, trails, and noncommercial youth and adult sports, and the use of land as a park, playground or athletic field.

Does not include horse or dog racing or the use of land for a stadium, gymnasium or similar structure.

Usually about a month, if everything is clear and understood. In some cases, it could be as short as two weeks.

5. What's the best way to find out specific information about my lot , or whether my plans need Conservation Commission review?

Visit the Conservation Commission office, or make an appointment with the Conservation Administrator.

6. Is there a penalty for not going along with the Conservation Commission's policies?

Yes. Fines may be imposed, and court action might be involved. After the fact filings could require engineered plans and other information requiring professional studies.

1. How do I determine within what Flood Zone my property is located?

The Federal Emergency Management Agency (FEMA) has prepared Flood Insurance Rate Maps (FIRMs) that generally show flood zones throughout the Town. If you are required to provide a flood zone certification to your insurance company then it is your responsibility to hire a Professional Land Surveyor or other qualified professional to make that certification. 2. Where do I call to report a road drainage problem?

For a new problem, contact Richie Anctil in the Engineering Division at 508-398-2231, ext 255 or for maintenance or cleaning of an existing drainage system contact the Highway Division at 508-775-2516.

3. How do I get an existing sign replaced/repaired or request a new sign?

For street sign maintenance or replacement, contact the Highway Division at 508-775-2516. For new signs, submit a completed Sign Request form and sketch to the Engineering Division. The Street Sign Committee meets monthly to review all new street sign requests. The Committee is made up of members from the Police, Highway, and Engineering Divisions. 5. Who do I contact to report a road problem on Routes 6, 6A or 28?

Routes 6, 6A, and 28 are State owned and maintained roads; therefore, you call Massachusetts Highway Department’s Taunton Offices at 1-800-635-3590 to report a problem on those roads. To report a problem with a sidewalk only on Routes 6A and 28, call the Yarmouth Highway Division at 508-775-2516.

6. How do I obtain a Road Opening Permit on a Town road?

Excavations within Town road layouts require permits that are issued through the Engineering Division. Any area within the town layout (right of way) that is dug requires a permit from the Town. 7. Why does the Town seal many residential streets with stone chips rather that with black asphalt?

Chips sealing a road has been found to be the most cost-effective method to maintain local neighborhood road surfaces. The average cost to fix drainage, patch, crackfill, and chip seal a road is $40,000 per mile of road. Whereas, the cost of an asphalt overlay with a smooth black finish is 4 to 5 times greater than that for chip sealing. 8. What is the “Phase II Stormwater Program” that has been mentioned at public meetings?

In 2003, the EPA promulgated the so-called “Phase II Stormwater Regulations” under the National Pollution Discharge Elimination System (NPDES). The Engineering Division prepared and filed a Notice of Intent (NOI) in order to meet these new EPA regulations. Yarmouth’s Phase II Stormwater Management Program outlines how the town proposes to address the following six (6) Minimum Control Measures through the use of Best Management Practices (BMPs) over the next five (5) years: 1. Public Education and Outreach on Stormwater Impacts; 2. Public Participation and Involvement; 3. Illicit Discharge Detection and Elimination; 4. Construction Site Stormwater Runoff Control; 5. Post Construction Stormwater Management in New Development/Redevelopment, and 6. Pollution Prevention/Good Housekeeping for Municipal Operations.

9. What are those black lines in the road?

As part of the Town’s Roadway (Pavement) Management Program, the Town fills cracks in the roads with a bituminous asphaltic material in order to extend the life of our roads. Filling cracks seals the pavement surface so that stormwater can not enter the road structure which if allowed would cause premature pavement failure during the annual freeze-thaw cycles.

1. Why does the YFD send out an Ambulance and a Fire Engine to a 911 phone call?

When there is an advanced life support call there needs to be a minimum of four or more people to respond. This is also determined by the Shift Commander.

4. May I get a permit at any of the three stations?

You would call the Highway Department. The Supervisor would come out to determine what condition the tree is in. The Town does not take down any trees that are living.

3. Who do I call for a pot hole in the road?

You would call the Highway Department for a pot hole repair.

4. What is the process if I want a speed limit another type of sign installed on a roadway?

All new sign requests need to be filled out on a sign request form. They are available at Town Hall and at the Highway Department. The process needs to go before the Sign Committee and is determined at a later date.

5. What do I do if I see a dead animal in the road?

You would call the Highway Department Monday through Friday from the hours of 7:00 a.m. - 3:30 p.m. After these hours you can call Animal Control unless it was a coyote or a deer then you would call Natural Resources

Children kindergarten age or older may apply for a Children's card with the signature of a parent or guardian in good standing. Teens 14 years or older may apply for a card with a school picture ID.

Planning

1. How is land developed?

With the help of Planning staff, the Planning Board regulates the creation of all residential and commercial subdivisions. Plans are submitted to the Board for their review, approval, and endorsement. The Board maintains a set of written standards for the design and construction of new roads and the placement of services that developers must follow.

2. What is the difference between a subdivision and an Approval Not Required (ANR) plan?

A subdivision involves the division of land into two or more lots and generally, involves the creation of a private road. An ANR plan is the division of land into lots with frontage on existing roads, whether those roads are public or private. Since the latter type of development does not create new roads, endorsement of an ANR plan by the Planning Board is a certification that Approval under the subdivision control law is Not Required.

3. Is my property in a floodplain?

Planning staff will help you determine whether your property lies in a floodplain, as designated by the Federal Emergency Management Agency (FEMA). The Planning office and the Engineering office have FEMA Flood Insurance Rate Maps for the entire town, which can be used to estimate where your property is and whether it is located within a floodplain.

4. What uses are allowed on my property?

Planning staff will review the the zoning map and the Zoning Bylaw's Use Code with you to give you some idea of the possibilities. There is also a zoning map located on the wall outside the Planning office and on this website (see the link, above). Printed copies of the bylaw and map are available for purchase at the Permits counter. While we will to review applicable codes with you, please note that the Building Commissioner, as the Zoning Enforcement Officer, is the definitive zoning authority.

5. Is my lot buildable?

Only the Building Commissioner, who is also the Zoning Enforcement Officer, can make that determination. Forms to request a determination of buildability are available at the Building Division office.

6. Is my lot grandfathered?

We do not. Certified plot plans, which are required when submitting applications to the Board of Appeals or when applying for certain building permits, must be prepared by a Registered Professional Land Surveyor.

11. Can you recommend a lawyer/surveyor?

Sorry, but no, we cannot. You might ask friends for their recommendations or look in the telephone directory for a list of names.

12. When does the Planning Board meet?

The Board holds a business meeting on the first and third Wednesday of each month.

13. How do I get an appointment to meet with the Planning Board to discuss a planning issue?

It's best to make your request in writing, but you might also call or drop by the Planning office with your verbal request. We try to put all requests to meet with the Board on the next available agenda. The deadline for getting on the next agenda is at 11:30 a.m. on the Friday before the meeting.

1. What can I do about annoying or harassing phone calls I have received?

If you are receiving annoying or harassing telephone calls, call the police department. Making such calls is against the law. An officer will speak with you and provide you with an "incident number" that your carrier will need. Call your carrier and request to speak with a representative from their Annoyance Call Bureau. Your phone carrier will give you detailed instructions on handling further calls and then will attempt to determine the origin of the calls. Once the location of the calls had been identified, the phone carrier will notify the Yarmouth Police and an officer will investigate the incident. 2. How do I report a crime or suspicious activity?

If you think the incident is an emergency, dial 9-1-1 right away and report what you saw to the dispatcher, who will then send the appropriate response to investigate. 1. I'm concerned about a senior, who do I call?

Call the Senior Center, 508 394-7606, ask to speak with the Outreach Coordinator who will determine the severity of the problem and what the next step should be. Depending on the circumstances she may call the person you're concerned about to schedule a home visit with them or if the situation needs immediate attention she will suggest you call Elder Services of Cape Cod and the Islands, 508 394-4630 to file an "Elder at Risk' report.

2. Can Senior Services help me with transportation?

Volunteers from Yarmouth's Moose Family Lodge provide rides to medical appointments on Tuesdays. On Thursdays we have a van that will take riders to the local grocery stores and once a month on a Monday the van goes to a mall. Call the Senior Center, 394-7606 to reserve your rides for any of these services. There is no charge for any of these services but donations are gratefully accepted to defray the costs.

For all other local rides you may call the Regional Transit Authority, 1 800 352-7155 or 508 385-1430, to schedule door to door service on the b-Bus. The charge to seniors $1.50 plus .05 per mile.

3. Is there anyone at the Senior Center who can help me with health insurance problems?

Yes, the regional S.H.I.N.E. (Serving Health Information Needs of Elders) program is located in our Senior Center. Staff and volunteers are available to answer any questions you have regarding health insurance, Medicare and Mass Health, Prescription Advantage, Medicare supplements and prescription coverage. Septic Systems

1. What is Title V?

The Massachusetts State Environmental Code, Title V is the regulation governing all septic systems in Massachusetts. The Department of Environmental Protection in conjunction with the local Board of Health, are responsible for enforcing the Title V Code. Title V was originally instituted in 1978 and was revised in 1995. In addition to Title V, the Yarmouth Board of Health, in 1978, promulgated the Town of Yarmouth Sewage Disposal Regulations which are more restrictive than Title V. In order to protect our drinking water and swimming beaches, it is important that all septic systems in Yarmouth conform to our local and state regulations.

2. My septic system has failed. What do I do?

Contact a design engineer who will design a new septic system based on the total number of bedrooms for residential properties. The design of the septic system is a multi-step process that usually involves a survey of your property, a soil and percolation test, and a sketch of your house floor plan all of which can take up to two to three months depending on your engineer’s schedule, the backlog of scheduled soil tests, and the review of the final septic plan by the Health Department. The Health Department is available to guide you through this process.

3. How often should I pump my septic system?

On average, every three to four years, depending on the use of the property. If your kitchen has a garbage disposal, your system should be pumped yearly.

Please note, make sure your septic system is designed for a garbage disposal.

4. I am selling my house. What is required?

According to the regulations of Title V, all septic systems must be inspected and certified prior to the sale of any property. Homeowners are required to hire a Massachusetts State Certified Inspector who is certified by the DEP to inspect and determine if your septic system meets the minimum standards. Most septic installers and engineers are certified to perform inspections. The septic inspector completes an inspection report with the details of the inspection. This report is provided to the homeowner and the Health Department who reviews the report and issues notices of correction, if warranted. In the event that a new septic system has been installed at the property within two years of the date of sale, an inspection would not be required, however, proof of the septic installation in the form of a Certificate of Compliance issued by the Health Department would be needed. There are certain exemptions from the inspection requirements, if the property is being transferred between family members i.e. between current spouses, between parents and their children, between full siblings, or between the grantor of a revocable or irrevocable trust where at least on of the beneficiaries is of a first degree relationship to the grantor. Please call the Health Department to determine if you qualify for an exemption.

5. I want to add a bedroom / addition to my house. What is requried?

The Health Department, through our office records, will help you determine if your existing septic system is large enough to accommodate your proposed renovations, in addition to meeting the required setbacks. Our office will also determine if your house lot is located within the Town of Yarmouth Zone II Areas of Wellhead Contribution. In general, properties located within this Zone II are limited to one bedroom per 10,000 square feet of land area. For example, a vacant lot of 20,000 square feet that is located within the Zone II is limited to two bedrooms with the installation of a standard Title V septic system. If your existing house and lot do not meet the minimum standard, you may be required to record a Deed Restriction on your property deed, which limits the total number of bedrooms, at the Barnstable County Registry of Deeds. Don’t forget to check with the Building Department to address any zoning issues.

6. I wish to landscape my yard. What do I need to know?

Prior to any landscaping or construction of any additions on your lot, check with the Health Department to determine the location of your septic system. Decks, sheds, and structures of any type cannot be built over the septic system components. These types of structures will prevent access to the septic components for required maintenance and repairs. Additionally, building structures may potentially damage the septic components leading to premature failure. Large plantings, such as trees and shrubs, will also potentially damage the system through excessive root growth that eventually clogs the system. Plants with shallow root systems, such as grass and ornamental flowers, are acceptable.

7. Is there a Tax Credit available for septic system installations?

Yes. In 1997, the legislature passed legislation allowing an income tax credit for septic system repairs for homeowners of residential properties. The total amount of tax credit allowed per tax year is $1500, although any excess credit amount may be applied in the three tax years following the first credit. More information may be obtained through your personal tax preparer or through the Massachusetts Department of Revenue.

8. Is there money available for septic pumping and/or replacement of my septic system?

Septic Pumping Reimbursement: This program, administered through the Health Department, provides low income families with monetary reimbursement for the cost of septic pumping. Residents must qualify, based on their total household income as established by the U.S. Department of Housing and Urban Development’s (HUD) Community Development Block Grant Program. 1. What do I need to apply for a sticker?

You need to be a resident of Yarmouth or taxpayer, a copy of the Yarmouth real estate tax bill and registraion of vehicle. Requesting the beach or disposal area stickers through the mail will require all of the above plus a stamped self-addressed envelope and a check made out to the Town of Yarmouth. Please see the mail in application located in the Town Clerk's Department of the website.

2. When are golf passes available for purchase?

We start selling golf passes in December for the following season. For the current costs please see the chart of golf fees.

3. When are dog licenses due?

All dogs need to be registered by June 30th, after that date we will be collecting a late fee of $15.00 per dog.

4. Where can I get a birth or death certificate?

The Town Clerk’s office issues both birth and death certificates. If, at the time of the birth or death, the person is a town resident, we will have the information in this office.

5. How can I receive a dog license through the mail?

Please send us a copy of the current rabies certificate from your Veterinarian, along with a stamped self-address envelope, and a check made payable to the Town of Yarmouth in the amount of ten dollars ($10.00) for each spayed/neutered dog, or the amount of twenty dollars ($20.00) for each male/female.

6. How can I receive a shellfish permit through the mail?

A resident or taxpayer in the Town of Yarmouth may receive one shellfish license per address. Send your request with a copy of your Massachusetts license, a check in the amount of thirty dollars ($30.00) or fifteen dollars ($15.00) if you are seventy-five (75) or older, and a stamped self-address envelope.

1. What is a small meter quarterly charge?

It is a charge that all town residents pay quarterly & it helps fund & maintain the mains throughout the town as well as your individual water service.

2. When do I receive my overage bill?

The Town of Yarmouth does not have an overage charge. There are four quarterly charges a year depending on the size of your meter and once a year we read your meter and bill you for consumption.

3. May the homeowner or their plumber remove the water meter for seasonal purposes?

Only the water department personnel may remove or install water meters as prohibited in accordance with Massachusetts General Law Chapter 165 section 11.

4. What should I do if a pipe burst within my home?

Shut the valve off on your side of the meter. If you do not have a shut off valve after the meter then shut the valve off before the meter. This stops the water from entering your household plumbing.

5. What do I do if the pipe before the water meter breaks or leaks?

Call the Yarmouth Water Department office at 508-771-7921.

6. I am a seasonal customer and I do not use my water in the winter. Why do I still receive a bill for a quarterly charge?

Regardless if you use the water or not it is there for your use. Unless, the house is declared vacant, quarterly charges apply. (see: Yarmouth Code 225-26)

7. What should I do if I am selling my home?

If you are selling your home through a real estate agent or privately the water department requires five business days to read the meter to prepare a final bill and transfer from. Also, supply the buyer's name and billing address as shown on the Purchase and Sales Agreement.

8. How do I read my water meter?

The water meter is read from left to right like a car odometer.

9. Is there a way to tell if I have a leak?

After making sure there is no water being used in the house or building, check the water meter for any movement as indicatd by the low flow indicator (typically a red triad shaped spinner). If there is any movement of this indicator there is a leak somewhere in your plumbing or fixtures.

10. What if the low flow indicator is moving?

One of the most common leaks, after dripping faucets, is the toilet. Remove the lid from the tank and add a small amount of talcum powder on the water surface. Any movement will indicate a leak. You may also put food coloring in the tank, wait fifteen to twenty minutes and check the toilet bowl. If there is discoloration in the bowl the flap in the tank may need to be cleaned or replaced.

If, your toilet is not leaking you will also need to check all the faucets inside and outside the house.

Don't forget to check your irrigation system by turning off the supply valve to the irrigation system and observing the low flow indicator on the water meter.

11. Is the water department a part of Dig Safe?

No. The water department is not a part of Dig Safe. State laws require anyone who digs to notify utility companies before starting. Digging can be dangerous and costly without knowing where underground facilities are located when requesting a mark out of the water main and service. You must supply the permit number as confirmation.
